Terms of Use
These Terms of Use ("Terms") govern your use of the Xava website and the Xava cashless tipping service. By using our website or service, you agree to these Terms. Xava is operated by Nerdcode (Pty) Ltd, trading as "Xava" (registration number 2015/238954/07), a company registered in South Africa and based in Gauteng.
1. What Xava is
Xava is a cashless tipping facilitator. A customer taps a Xava wristband (or scans a worker's QR payment screen) with their phone, a tipping page opens in their browser, they choose an amount and pay digitally. Tips are processed by a licensed South African payment provider, and the worker's tips are paid out to the worker's own verified bank account.
- Xava is not a bank and does not provide banking, stored-value or e-money services.
- Tips are voluntary, discretionary, one-off payments. No goods or services are sold through Xava.
- Xava never sees or stores card numbers or banking login details — all payment processing happens within our payment provider's secure, PCI-DSS-compliant environment.
2. Tipping
- The tip amount and any applicable service charge are shown to you on the tipping page before you pay. By confirming payment you authorise the transaction.
- Tips are given freely by the tipper to the worker. Once a tip is completed it is final, subject to the dispute process below.
- Workers receive their tips into their Xava profile and are paid out to their own verified bank account on a defined payout cycle.
3. Worker registration
- To receive tips, a worker must register and provide accurate details, complete identity verification where required by law, and provide a bank account in their own name.
- Payouts are made only to that verified account. See Start Using Xava for the registration steps.
- You are responsible for keeping your login details safe and your profile information up to date.
4. Our service levels (SLAs)
- Enquiries: contact-form and general enquiries are attended to within 5 business days.
- Disputes: tip and payment disputes are handled on a 72-hour service level from the time the dispute is raised with us.
Raise any enquiry or dispute at queries@xava.africa, or through the contact form on our website. Please include the date, approximate time and amount of the tip where relevant, so we can trace the transaction quickly.
5. Refunds and disputes
- Because tips are voluntary, one-off payments, refunds are only considered in genuine error or dispute cases (for example a duplicated or mistaken payment).
- Approved refunds are processed through our payment provider back toward the original payment method, and are handled case-by-case.
- Disputes are acknowledged and worked within the 72-hour service level set out above.
6. Acceptable use
You may not use Xava to do anything unlawful, fraudulent or abusive — including attempting to tip with funds you are not entitled to use, interfering with the service's operation or security, misrepresenting your identity, or using the service to harass others. We may suspend profiles or payouts pending review where we detect suspicious or unlawful activity.
7. Privacy
We process personal information minimally and lawfully under POPIA. Our Privacy Policy explains what we collect, why, how long we keep it and your rights.
8. Intellectual property
The Xava name, logo, website content and designs are the property of Nerdcode (Pty) Ltd and may not be copied or used without our written permission.
9. Availability and liability
We work hard to keep Xava available and secure, but we cannot guarantee uninterrupted availability of the website, tipping pages or third-party payment services. To the maximum extent permitted by South African law, Xava is not liable for indirect or consequential loss arising from use of the website or service. Nothing in these Terms limits any right you have under the Consumer Protection Act or other applicable law.
10. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available on this page, with the "Last updated" date revised accordingly. Continued use of the service after an update means you accept the revised Terms.
11. Governing law & contact
These Terms are governed by the laws of the Republic of South Africa. Questions about these Terms: queries@xava.africa.
